When to hire a lawyer after a car accident
Which crashes you can handle yourself, when an attorney is worth the fee, how contingency fees work, and what to do if you are the one being sued.
You usually do not need a lawyer for a crash that only damaged cars and that the insurers are paying promptly. Consider one when someone is seriously hurt, fault is disputed, the at-fault driver's coverage may not be enough, an insurer denies or lowballs a significant claim, or you are being sued. Most car accident attorneys offer a free first consultation, so a short call can tell you which side of that line you are on.
A quick way to decide
| Situation | Usually handle it yourself | Worth a consultation | Strongly consider hiring |
|---|---|---|---|
| Property damage only, fault is clear, insurer is paying | Yes | ||
| Minor injury, treated and healed within weeks | Often | If the offer seems low | |
| Fault is disputed or shared | Yes | If injuries are involved | |
| Injury needing surgery, long treatment, time off work, or lasting effects | Yes | ||
| Your losses may exceed the other driver's limits | Yes | Yes, if injuries are serious | |
| Insurer denies a significant claim or stops responding | Yes | If it looks like bad faith | |
| You are sued, or the claim against you may exceed your limits | Yes | ||
| A death resulted from the crash | Yes |
For property-only disputes, the cost of a lawyer often exceeds the amount in play, and tools such as small claims court or the appraisal clause fit better.
Why injuries change the math
Injury claims are where insurers and claimants most often disagree, and where mistakes are hardest to undo:
- Value is hard to judge. Pain, future treatment and lost earning capacity have no price tag. Attorneys who handle these cases see what similar claims settle for in your area.
- A release is final. Once you sign a release of liability, you generally cannot reopen the claim if your condition turns out worse than expected.
- Limits cap what you can collect. If the at-fault driver's bodily injury liability limit is low, recovering more may depend on your own underinsured motorist coverage, the driver's personal assets, or other responsible parties, such as an employer if the driver was working.
- Liens come off the top. Health insurers, Medicare or Medicaid and some medical providers may have a right to be repaid from your settlement, which affects what you actually take home.
How lawyer fees work
Most car accident injury lawyers work on contingency: they collect a percentage of what you recover and nothing if you recover nothing. Cornell Law School's Legal Information Institute describes personal injury contingency fees in a range of roughly 20% to 50% of the recovery. The ABA's model ethics rule, which most states follow, requires a contingency agreement to be in writing and signed by the client, to explain how the fee is calculated, and to say which expenses the client must pay.
Two details in the agreement change your net recovery: whether the percentage rises if the case goes to trial, and whether the fee is taken before or after case costs (filing fees, records, expert witnesses).
A worked example
These numbers are hypothetical. Suppose a claim settles for $60,000, the agreed fee is one-third, case costs are $2,400, and a health insurer has a $7,500 lien.
| Fee taken before costs | Fee taken after costs | |
|---|---|---|
| Settlement | $60,000 | $60,000 |
| Case costs | $2,400 | $2,400 |
| Attorney fee | $20,000 (one-third of $60,000) | $19,200 (one-third of $57,600) |
| Health insurer lien | $7,500 | $7,500 |
| You receive | $30,100 | $30,900 |
Ask any lawyer you interview to walk through a similar example using their own agreement.
Timing matters
- Deadlines. Each state sets a statute of limitations for injury and property damage suits, often two or three years but shorter in some states and for claims against government entities. See statutes of limitations for car accident claims.
- Evidence fades. Video from nearby businesses may be overwritten within days; vehicles get repaired or salvaged. A lawyer brought in early can send preservation letters.
- Statements to the other insurer. You are not required to give a recorded statement to the at-fault driver's insurer. If injuries are involved, getting advice first is reasonable.
- The demand. Injury claims usually resolve after treatment ends, through a demand letter that documents your losses. Settling before you know the full extent of an injury is the most common way people leave money behind.
If you are the one being sued
Your liability coverage includes a defense: when you are sued over a covered accident, your insurer generally hires and pays a lawyer to defend you, and that cost does not reduce your policy limit. Report the lawsuit to your insurer immediately and send it the papers, because late notice can jeopardize coverage.
The insurer's lawyer represents you, but the insurer is paying. If the damages claimed exceed your limits, or the insurer says some of the claim is not covered, consider hiring your own attorney as well to protect your personal assets and press the insurer to settle within limits. insurance bad faith explained explains why that pressure matters, and how much liability coverage do you need? covers how to avoid the problem next time.
How to choose a lawyer
Questions to ask in the free consultation:
- How many car accident cases like mine have you handled in the past few years, and how many went to trial?
- Who will actually work on my case day to day?
- What is your fee percentage, does it change if we file suit or go to trial, and is it calculated before or after costs?
- Which costs will I owe if we lose?
- How often will I get updates, and how quickly do you return calls?
- What do you think my case is worth, and what could reduce that?
Your state bar association can confirm a lawyer's license and discipline history, and many run lawyer referral services. Be wary of anyone who contacts you uninvited right after a crash; scams that target drivers after an accident describes common schemes.
Key takeaways
- Property-only crashes with clear fault rarely need a lawyer; serious injuries, disputed fault, low limits and lawsuits often do.
- Contingency fees must be in a written agreement; check the percentage, trial escalators and whether costs come out first.
- Do not sign a release or settle an injury claim until you know the full extent of the injury.
- If you are sued, notify your insurer at once; consider your own attorney if the claim may exceed your limits.
- Deadlines vary by state and can be short, so get advice early when injuries are involved.
